7 Critical Indonesia Employee Resignation Law Mistakes
Your Employee Resigned Without Notice. What Can Your Company Legally Do?
Imagine your restaurant manager in Bali sends a midnight message announcing immediate resignation. Bookings are scheduled, staff need supervision, and company keys remain with the employee. What can management legally do? Understanding Indonesia Employee Resignation Law helps employers respond without creating another dispute.
Unexpected departures can disrupt operations, but Indonesia Employee Resignation Law distinguishes voluntary resignation, unauthorized absence, and termination initiated by an employer. Each situation carries different procedures and financial consequences. Withholding payments or threatening automatic penalties may increase exposure.
What Does the Thirty Day Notice Rule Mean?
Under Article 36(i) of Government Regulation No. 35 of 2021, voluntary resignation ordinarily requires written notice at least thirty days before the proposed departure. Employees must also have no outstanding service bond and continue fulfilling their duties until the resignation date.
Indonesia Employee Resignation Law therefore gives employers a framework for planning handovers, arranging replacements, and protecting continuity. However, a resignation letter giving immediate effect does not automatically authorize the company to impose any penalty it chooses.
Review the employment agreement, company regulations, and collective agreements. These documents may address resignation procedures, confidentiality, return of equipment, and lawful obligations. Indonesia Employee Resignation Law should be considered alongside those terms, not replaced by them.
First Response: Document, Communicate, Verify
When an employee announces an immediate departure, acknowledge the message and request written clarification of the intended final working day. Preserve communications, attendance records, and evidence of outstanding duties. Ask whether an emergency, illness, or other legitimate circumstance explains the situation.
For Indonesia Employee Resignation Law compliance, employers should distinguish an employee who expressly resigns from someone who simply stops attending work. Do not immediately label either person dismissed, absent without cause, or liable for damages before establishing the facts.
Arrange secure access to business systems, customer information, cash, and company property. Restrict access proportionately and document every step. Indonesia Employee Resignation Law does not eliminate an employer’s responsibility to safeguard personal data and respect employee rights.
When Does Absence Become a Termination Ground?
An employee who disappears without explanation presents a different scenario. Article 36(j) and Article 51 of PP 35/2021 address absence for five or more consecutive working days without a valid written explanation, after two proper written summonses from the employer.
Under Indonesia Employee Resignation Law, five missed days alone do not automatically establish a completed, lawful termination. Employers should document the dates, send written summonses, retain delivery evidence, and give the employee an opportunity to explain.
If termination becomes disputed, the broader industrial relations framework applies. Following Constitutional Court Decision No. 168/PUU-XXI/2023, unresolved termination disputes require attention to bipartite negotiation and the applicable dispute resolution process. Indonesia Employee Resignation Law must be read alongside those safeguards.
Can Employers Deduct Salaries or Demand Compensation?
An unexpected resignation may cause real financial losses, but frustration does not create an automatic right to withhold earned wages. Final calculations should distinguish salary already earned, lawful deductions, reimbursable advances, outstanding benefits, and enforceable contractual claims.
Indonesia Employee Resignation Law does not prescribe a universal fine equal to thirty days of salary whenever notice is missing. Whether compensation may be pursued depends on the employment relationship, contractual terms, applicable law, evidence of loss, and proper dispute procedures.
Avoid unilateral deductions without a defensible legal basis. Indonesia Employee Resignation Law also requires attention to the employee’s final entitlements rather than assuming misconduct cancels everything owed.
What Must the Company Pay?
Article 50 of PP 35/2021 provides that employees who voluntarily resign while satisfying Article 36(i) conditions are entitled to compensation for applicable outstanding rights and separation pay, with the latter amount governed by employment agreements, company regulations, or collective agreements.
Article 51 also addresses rights in qualifying absence related termination cases. Indonesia Employee Resignation Law does not mean that every departure triggers ordinary employer initiated severance pay, nor that every departing employee receives nothing.
Check unused annual leave that remains payable, applicable return travel costs, contractual benefits, and outstanding wages. For fixed term employees, assess whether statutory PKWT compensation or other consequences apply. Indonesia Employee Resignation Law analysis must reflect the actual contract type and reason the relationship ended.
Protect Operations Without Escalating Conflict
Employers can request a handover covering passwords, customer bookings, inventory, financial records, equipment, and unfinished projects. Where cooperation is unavailable, use internal controls to recover access without intimidation or unauthorized interference with private accounts.
Indonesia Employee Resignation Law compliance improves when HR maintains clear resignation templates, written notice procedures, exit checklists, and payroll records. Managers should understand when to involve legal advisers rather than improvising sanctions.
For hospitality businesses, plan backup staffing for critical roles. A temporary replacement, documented delegation, and client communications often reduce damage more effectively than an aggressive legal threat.
