Indonesia Introduces Up to 100% Tax Penalty Relief: Is Your Business Eligible?

Indonesia has introduced a significant opportunity for taxpayers to address certain outstanding administrative sanctions. Director General of Taxes Decree No. KEP-239/PJ/2026, applicable from 8 October 2026, allows qualifying reductions or eliminations reaching 100%, depending on the circumstances.

For companies, Tax Penalty Relief can support a broader review of previous filings, overdue payments, assessments, and tax compliance. However, the policy is conditional. It does not automatically cancel outstanding principal taxes, and not every penalty qualifies.

What Does the New Policy Cover?

KEP-239/PJ/2026 operates alongside Minister of Finance Regulation No. 118/2024, as amended by PMK No. 71/2026. The decree identifies specific administrative sanctions eligible for consideration, subject to procedural and timing requirements.

Tax Penalty Relief covers qualifying late annual income tax returns through tax year 2025 and periodic returns through September 2026, where the applicable underpayment conditions are met. The relevant filing window runs from 8 October 2026 through 30 June 2027.

Certain voluntary corrections resulting in additional tax payable may also qualify when returns are corrected and related payments are completed within the prescribed period. Tax Penalty Relief can also apply to specified late payments or deposits associated with eligible returns.

What About Assessments and Collection Notices?

The policy extends beyond ordinary filing mistakes. Eligible administrative penalties in tax assessment letters and tax collection notices may qualify, including certain land and building tax matters.

Some qualifying assessments must have been issued during the designated period, with principal tax settled by 30 June 2027. Other provisions address notices issued before 8 October 2026, subject to their own payment requirements.

Tax Penalty Relief also encompasses certain assessments relating to the Voluntary Disclosure Program, where qualifying notices are issued by 31 December 2027 and relevant principal taxes are paid by that date.

Businesses should examine each notice separately. Tax Penalty Relief depends on the type of sanction, issuance date, payment history, and applicable decree provision rather than simply whether a penalty remains outstanding.

Why Acting Before December 2026 Matters

Timing may significantly affect the amount reduced. For specified late filings, voluntary corrections, and late payments, qualifying actions completed by 31 December 2026 may obtain full administrative penalty relief. Later qualifying actions can receive lower reductions.

This makes Tax Penalty Relief a time-sensitive consideration for finance teams. Companies should identify eligible periods, calculate outstanding principal tax, and assess whether documentation can be prepared before the earliest deadline.

Importantly, Tax Penalty Relief is not a general tax amnesty. The underlying tax liability remains payable where required, even when an administrative penalty is reduced or eliminated.

Key Deadlines to Monitor

The initial 100% window for specified categories ends on 31 December 2026. Many qualifying filing, correction, and payment actions must be completed no later than 30 June 2027.

Certain Voluntary Disclosure Program assessments have a separate principal tax payment deadline of 31 December 2027. Applications for Tax Penalty Relief must reach the Directorate General of Taxes by 1 October 2028.

These dates perform different functions. A late application cannot necessarily be rescued by having paid early, and meeting the application deadline does not override earlier payment or filing conditions.

Who Can Apply, and What Is Required?

Tax Penalty Relief requires an application, not merely an eligible transaction. Taxpayers must satisfy the relevant provisions of PMK No. 118/2024 as amended, together with the additional requirements in KEP-239/PJ/2026.

Depending on the circumstances, applicants may need evidence of principal tax settlement, supporting returns, assessment documents, and declarations addressing the reason for the sanction.

Tax Penalty Relief applications also involve restrictions concerning lawsuits or other legal remedies. Where relevant, taxpayers must declare that they are not pursuing such proceedings or provide evidence of withdrawal, following the prescribed requirements.

Businesses should check whether the administrative penalty remains unpaid or unsettled, as the decree includes conditions concerning the status of the sanction itself.

How Should Companies Prepare?

A practical Tax Penalty Relief review begins with a complete inventory of outstanding returns, corrections, payments, assessment letters, collection notices, and penalties. Finance teams should reconcile these items with bank records and tax payment evidence.

Next, categorize each item against the decree. Tax Penalty Relief eligibility may differ between an overdue return, a voluntary correction, and an assessment issued after an audit. Treating every case alike risks incorrect assumptions.

Management should also examine whether financial statements, tax returns, and actual business activities are consistent. Although corporate licensing records do not automatically determine eligibility, unresolved administrative inconsistencies may warrant a separate compliance review.

Before submitting, assign responsibility for gathering documents and verifying important dates. Keep copies of payment confirmations, correspondence, tax returns, and calculations showing how each sanction arose. Where multiple tax periods or entities are involved, prepare separate schedules. This approach helps decision makers understand potential savings without overlooking principal liabilities or procedural restrictions.
